Renting
Are landlords or tenants responsible for mold in Pennsylvania?
Landlords generally must keep a rental habitable, which includes fixing leaks and serious dampness from the building. Tenants are expected to report problems and not cause the moisture. Pennsylvania law is fact-specific. We are not lawyers and this is not legal advice.
What we can do is write down the moisture source we can see — a roof leak versus a fan that was never run — so both sides are arguing about the building instead of about a smell. Code offices and attorneys handle the rest.
